Introduction

These Terms and Conditions (“Terms”) govern access to and use of www.oralux.in and purchases of products offered by Oralux operated by Healthwise (“Company,” “we,” “us,” or “our”). By accessing the site, creating an account, or placing an order, users agree to these Terms and our Privacy Policy and other referenced policies.

Eligibility and Accounts

  • Users must be at least 18 years of age and capable of forming a binding contract under applicable law.
  • Account holders are responsible for safeguarding login credentials and for all activities under the account. Notify support immediately of any unauthorized use.

Orders and Acceptance

  • All orders are offers to purchase subject to acceptance. We may accept, reject, or cancel orders at our discretion, including due to limited stock, pricing or content errors, suspected fraud, or regulatory restrictions.
  • Order confirmation emails acknowledge receipt; acceptance occurs when the order is dispatched and a tracking confirmation is issued.

Pricing, Taxes, and Promotions

  • Prices are listed in INR and inclusive of applicable GST unless stated otherwise. Final payable amounts and any shipping or COD fees are shown at checkout.
  • Promotional offers, coupon codes, and bundles are time-limited, non-transferable, and subject to separate terms; we may modify or withdraw them at any time where permitted by law.

Payment

  • Accepted methods include UPI, Net Banking, Credit/Debit Cards, select Wallets, and COD where available. Payments are processed via PCI DSS–compliant partners; we do not store full card details.
  • For COD, payment is due in full at delivery. We may decline COD for certain PIN codes, order values, or customers.

Shipping and Delivery

  • Serviceable across India via leading couriers. Standard delivery typically takes 2–7 business days by location; remote areas may take longer. Dispatch usually occurs within 24–48 business hours on business days.
  • Shipping fees are displayed at checkout based on PIN code and service level. Free shipping applies to orders over ₹15,000 unless otherwise stated. Delivery timelines are estimates and not guarantees.

Delivery Attempts and Risk of Loss

  • Couriers generally attempt 2–3 deliveries. If undelivered, parcels may be returned to origin; reshipping may incur additional charges.
  • Risk of loss passes upon delivery to the address provided; ensure accurate address details and safe delivery access.

Returns, Cancellations, and Refunds

  • 7-day returns from delivery for unused/unopened items in original packaging with all components and proof of purchase. Items showing wear, physical damage, or missing parts may be denied or subject to restocking fees.
  • If incorrect, damaged, or defective on arrival, contact support within 48 hours with photos/video; after verification, we’ll arrange replacement or refund.
  • Before dispatch, orders may be cancelled for a full refund. After dispatch, cancellations are processed as returns per this policy.
  • Refunds are issued to the original payment method where possible; processing typically takes 5–7 business days after inspection. Bank/card posting times can vary.

Warranty

  • Device warranty: 12 months against manufacturing defects from date of purchase. Excludes misuse, unauthorized repairs, physical damage, water ingress beyond IP rating, and normal wear and tear.
  • Warranty is void if damage results from failure to follow cautions, instructions, installation, or maintenance requirements in the User Manual or product packaging, including improper cleaning agents, operation outside rated conditions, unauthorized modifications, or non‑approved accessories.
  • Claims require proof of purchase and a diagnostic process; remedies may include repair, replacement, or refund at our discretion as permitted by law.

Product Information and Availability

  • We strive for accuracy in descriptions, images, specifications, and pricing, but errors may occur. Colors and finishes can vary by display settings and manufacturing batches.
  • We may change, limit, or discontinue products or features without prior notice.

Acceptable Use

  • Users must not interfere with site operations, attempt unauthorized access, introduce malware, scrape content, engage in fraud, or violate any applicable law.
  • Reviews and content must be lawful, accurate, non-infringing, and non-defamatory. We may remove or moderate content that violates these standards.

Intellectual Property

  • All content on the site, including text, graphics, logos, icons, images, audio/video clips, downloads, and software, is owned by or licensed to the Company and protected by applicable IP laws.
  • Users receive a limited, non-exclusive, non-transferable license to access and use the site for personal, non-commercial purposes. Any reproduction, distribution, modification, or derivative use requires prior written consent.

Third-Party Services and Links

  • The site may link to third-party websites or integrate third-party services (e.g., payment gateways, logistics tracking). We are not responsible for their content, policies, or practices.
  • Use of third-party services is subject to those providers’ terms and privacy policies.

Privacy and Data Protection

  • Personal information is processed per our Privacy Policy, which forms part of these Terms. The Privacy Policy identifies the legal entity responsible for data processing and explains purposes, sharing, security, and rights.

Communications and Consent

  • By creating an account or placing an order, users agree to receive transactional communications (order updates, service notices).
  • Marketing communications are sent only with consent or as otherwise permitted; opt out anytime via provided mechanisms.

Limitation of Liability

  • To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenues, data, or use arising from use of the site or products.
  • Our aggregate liability for any claim relating to products or services shall not exceed the amount paid for the order giving rise to the claim.

Disclaimer of Warranties

  • Except as expressly stated (e.g., limited device warranty), the site and products are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the extent allowed by law.

Indemnity

  • Users agree to indemnify, defend, and hold harmless the Company, its directors, officers, employees, and agents from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from user breach of these Terms, misuse of the site, or violation of laws.

Governing Law and Dispute Resolution

  • These Terms are governed by the laws of India without regard to conflicts principles. Subject to the arbitration clause below, courts at Bangaluru, Karnataka shall have exclusive jurisdiction.
  • Any dispute arising from or in connection with these Terms shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed in accordance with the Act. Seat and venue of arbitration: Bengaluru, Karnataka. Language: English.

Changes to Terms

  • We may update these Terms from time to time. Changes take effect upon posting the revised Terms on the site with an updated “Last updated” date. Continued use constitutes acceptance.

Severability and Waiver

  • If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect. Failure to enforce a right or provision is not a waiver of such right or provision.
